Dear Sir,

I would like to to draw your attention to the case of Desmond Nunugwo. He died while in Economic and Financial Crimes Commission (EFCC) custody in June 2016. His family only got to know of his death through media reports published by the EFCC. The circumstances of his death remain unclear. Since his death his body has been lying at the morgue awaiting an autopsy. There has been no investigation into his death despite the Attorney General, in responding to requests from Desmond Nunugwo's family in August 2016, directing the Nigeria Police Force (NPF) and the Department of State Services (DSS) to investigate the death. Since the death of Desmond Nunugwo, his family has repeatedly called for investigations into his death. In August 2016, they wrote to the Attorney General of the Federation of Nigeria requesting him to take over investigations into the death of Desmond Nunugwo because they were not confident that the police would conduct an impartial investigation. The family also requested for the body of Desmond Nunugwo being held by the state be released to them for a befitting burial upon conclusion of investigations.

I would like to urge you today to conduct a prompt, thorough and independent investigation into the death of Desmond Nunugwo and ensure the outcome of the investigation is made public. Please appeal to the relevant authorities that if the independent investigations reveal that anyone was responsible for Desmond Nunugwo's death, they are brought to justice in a fair trial before ordinary civilian courts and without recourse to the death penalty. I am also asking you to ensure that Desmond Nunugwo's family is allowed to bury him as soon as the investigations are concluded.
